These Terms of Service ("Terms") apply to the services of Crocfish OÜ ("CROCFISH", "we", "us"):

You may browse our website and use its content for personal, non-commercial purposes. Members of the press and content creators may use the material in our press kits (screenshots, trailers, logos, fact sheets) to report on or create content about our games.
We try to keep the website accurate and available, but we do not guarantee that it is always complete, up to date or free of interruptions. Release dates, prices and features shown on the website may change.
Our games are sold and distributed through third-party stores (e.g. Steam, itch.io, Google Play, Apple App Store). Your purchase, download, refunds and use of a game are also governed by the terms of the store you got it from, for example the Steam Subscriber Agreement.
We grant you a personal, non-exclusive, non-transferable licence to play our games for private, non-commercial purposes. You may not copy, resell, modify, decompile, disassemble or otherwise reverse engineer our games, or extract their code or assets, except where the law expressly allows it.
You are welcome to stream and publish videos and screenshots of our games (including monetized videos), without asking us first, as long as you do not present them as your own work, and do not present modified versions, extracted code or assets, or edited footage as the original game in a way that misleads people about the game or about Crocfish.
Crocfish Publisher is an internal tool that we host ourselves. We use it only to schedule and publish our own content (videos and posts about our games) to social media accounts owned by Crocfish, such as our TikTok, Bluesky, Instagram and Facebook accounts.
Our games, the names CROCFISH, FAIL GAMES, Water Droplet Simulator, Tunnelborn and our other game titles, our logos, artwork, music, videos and website content are owned by Crocfish OÜ or its licensors and are protected by copyright and trademark law. Except as allowed in these Terms (e.g. press kit use, videos of our games), you may not use them without our written permission.
When using our website, games or community channels (e.g. our Discord servers), you agree not to:

Our website and games link to, or use, third-party services (e.g. Steam, itch.io, YouTube, TikTok, Discord). Those services have their own terms and privacy policies, and we are not responsible for their content or practices.
Launch-notification and newsletter sign-ups are voluntary and free. You can unsubscribe at any time, as described in our Privacy Policy.
Our website and free content are provided "as is". To the extent permitted by law, we are not liable for indirect or consequential damages arising from the use of our website or games.
Nothing in these Terms limits our liability for intent or gross negligence, for injury to life, body or health, or any liability that cannot be limited under applicable law. If you are a consumer, you keep all rights that the consumer protection laws of your country of residence give you.
We may update these Terms from time to time. The latest version will always be available on this page with its "Last Updated" date. Significant changes will be communicated clearly.
These Terms are governed by the laws of the Republic of Estonia. If you are a consumer in the EU, you also keep the protection of the mandatory laws of your country of residence, and you may bring claims in the courts there.
